Contract Agreement (Form PW2b-5)
THIS AGREEMENT made the /02/2020 day of between the Ministry of Local Government of the People Republic of Bangladesh represented by the Zila Parishad, Panchagarh. (hereinafter called “For The Procuring Entity”) of the one part and M/S Maria International, Proprietor- Md. Sofiqul Islam, Zila Parishad Super Market, Panchagarh (hereinafter called “ The Contractor”) of the other part.
WHEREAS the Procuring Entity invited Tenders for certain works viz, 1.Detailed Estimate For Construction of Chanden bari paikerpara jame Mosque ozukhana Under Boda Upazila Dist Panchagarh. 2.Detailed Estimate for Development work of Chirakuthi Graveyard Eid gaho math under Boda upazila Dist Panchagarh. 3.Detailed Estimate For Development work of Doulutpur jame Mosque House of Tobibur Under Boda Upazila Dist Panchagarh. 4.Detailed Estimate for Development work of jamkurapara Attem Khana and LillaBoarding Under Boda Upazila Dist Panchagarh. 5.Detailed Estimate For Development work of Madha tessarpara jame mosque Assruf House Under Boda Upazila Dist Panchagarh. 6.Detailed Estimate For Repair work of zurderpara jame mosque Under Panchagarh sadar Upazila Dist Panchagarh 7.Detailed Estimate for construction work of Boda Upazila shohid minar under Boda Upazila Dist Panchagarh. 8.Detailed Estimate for development work of kugea para Dakhil Madrasa under panchagarh sadar upazila Dist Panchagarh. 9.Detailed Estimate for purchase furniture at jala rice mil malik somittee ghor under panchagarh sadar upazila dist Panchagarh. e-Tender Notice 03/2018-2019, Memo no-46.47.7700. 002.35. 001.17.1206, Date: 15-01-2020 and has accepted a Tender by the Contractor for the execution of those works in the sum of Taka 10,45,000.00 (Ten lakh fourty Five Thousand taka only), (hereinafter called “the Contract Price”).

NOW THIS AGREEMENT WITNESSETH AS FOLLOWS:
1. In this Agreement, words and expressions shall have the same meanings as are respectively assigned to them in the General Conditions of Contract hereinafter referred to.
2. The documents forming the Contract shall be interpreted in the following order of priority.
(a) The signed Contract Agreement
(d) The Notification of Award
(c) The completed Tender
(d) The Particular Conditions of Contract
(e) The General Conditions of Contract
(f) The Technical Specifications
(g) The General Specifications
(h) The Drawings
(i) The Priced bill of Quantities and the Schedules
(j) Any other document listed in the PCC as forming part of the Contract
3. In consideration of the payments to be made by the Procuring Entity to the contractor as hereinafter mentioned, the contractor hereby covenants with the Procuring Entity to execute and complete the works and to remedy any defects therein conformity in all respects with the provisions of the contract.
4. The Procuring Entity hereby covenants to pay the contractor in consideration of the execution and completion of the works and the remedying of defects therein, the contract Price or such other sum as may become payable under the provisions of the contract at the times and in the manner prescribed by the contract.
